Miller Barondess, LLP Proceeds with Peter Barker-Homek’s Claims Against TAQA

LOS ANGELES - Tuesday, October 11th 2011 [ME NewsWire]

(BUSINESS WIRE)-- Peter Barker-Homek, represented by law firm Miller Barondess, LLP, sued TAQA last year in Michigan federal court for violations of Michigan’s whistle-blowing law after TAQA fired him for trying “to put a stop to the kickbacks, bribery, accounting fraud and corruption” at the company, his complaint alleges. Judge John Corbett O’Meara granted a motion to dismiss Mr. Barker-Homek’s lawsuit against TAQA on jurisdictional grounds.

Skip Miller of Miller Barondess, LLP, representing Mr. Barker-Homek, stated: “This is a ruling on jurisdiction only; the trial court said that there is no jurisdiction in Michigan. We disagree. The ruling is not on the merits of the claims of fraud and corruption in the complaint (attached). A well-known forensic accountant analyzed TAQA’s books and accounting statements and opined on Mr. Barker-Homek’s allegations of wrongdoing by TAQA.”

Mr. Miller added: “We are going to appeal and will continue to seek justice in the U.S. courts. We believe it is wrong for the court to say that TAQA did not do business in Michigan, when it acquired CMS Energy in Jackson, Michigan and ran its worldwide business from there during the time period in issue, 2007-2010.”

“This ruling on jurisdiction is not going to stop these issues from being fully examined in a court of law and the claims of our client adjudicated on the merits. This is a classic case of a CEO trying to stop ongoing corruption by powerful government officials and then being ousted, and threatened, when he refused to go along.”

Mr. Barker-Homek’s litigation attorney is Skip Miller of Miller Barondess, LLP in Los Angeles. Mr. Miller can be reached at (310) 552-5251 or by e-mail at smiller@millerbarondess.com.
