TruePosition Wins Appeal in Its Patent Infringement Suit with Andrew Corporation

TruePosition Obtains Permanent Injunction Against Andrew Corporation; Awarded More than $45 Million in Damages; Previous Court Dismissed Andrew’s MREL Case

(BUSINESS WIRE)-- TruePosition, Inc., a leading provider of wireless location technologies and solutions and a subsidiary of Liberty Media Corporation, today announced that the United States Court of Appeals for the Federal Circuit has affirmed a judgment and permanent injunction against Andrew Corporation, a division of Commscope, Inc., involving Andrew’s willful infringement of a patent held by TruePosition. In addition to obtaining a permanent injunction against Andrew, TruePosition won damages exceeding $45 million.


The case involves TruePosition’s “144” patent relating to control channel Uplink Time Difference of Arrival (U-TDOA) technology. Locating a phone in “idle mode” (that is, not engaged in a voice call) using U-TDOA on the control channel is crucial for mission-critical applications such as border security, critical infrastructure protection, and law enforcement.


In 2007, a jury in the Delaware Federal District Court determined that Andrew Corporation willfully infringed TruePosition’s 144 patent with respect to sales of its Geometrix® wireless location system to the Saudi Telephone Company (STC). The jury awarded TruePosition $45.3 million in damages, and the lower court subsequently issued a permanent injunction prohibiting Andrew’s further infringement.


Following nearly three years of post-trial proceedings, the Court of Appeals has affirmed the lower court’s judgment.


In a separate but related matter, Andrew asked the Delaware Court to determine that Andrew’s Multiple Range Estimation Location System (MREL) did not infringe the 144 patent. In March of this year, the Court granted TruePosition’s motion to dismiss the case.

These actions are not TruePosition’s first against Andrew. In a prior case, TruePosition obtained a settlement from Andrew worth $42 million relating to certain patents not involved in the 144 case. The prior case is TruePosition, Inc. v. Allen Telecom, Inc. (D. Del. 2001).
